US Court Seeks Clarification on Returning Forfeited Crypto from 2016 Bitfinex Hack
A federal court has yet to rule on a motion from the US government seeking to return cryptocurrency seized in connection with the 2016 Bitfinex hack, with the judge requesting further clarification before making a decision.
In a Jan. 28 filing in the US District Court for the Southern District of New York, Judge Colleen Kollar-Kotelly directed federal prosecutors to provide additional explanation regarding the government’s request to return funds to Bitfinex. The order comes as part of the legal proceedings against Ilya Lichtenstein and Heather Morgan, the husband-and-wife duo convicted of laundering funds stolen from the exchange.
Court Questions Legality of Fund Return to Bitfinex
The US government seized a total of 94,643 Bitcoin (BTC), alongside smaller amounts of Bitcoin Cash (BCH), Bitcoin Satoshi Vision (BSV), and Bitcoin Gold (BTG) from Lichtenstein, who also admitted to being the mastermind behind the 2016 hack. The funds, worth billions of dollars today, were confiscated as part of the criminal case against the pair.

Judge Kollar-Kotelly, however, raised concerns that returning the stolen crypto to Bitfinex might improperly reduce the amount of the forfeiture order, which could conflict with prior court rulings on similar cases. She requested the US government to clarify its stance by Feb. 4, after which she will make a determination on whether the exchange should receive restitution.
One of the Largest Crypto Heists in History
The August 2016 Bitfinex hack resulted in the theft of 119,754 BTC, making it one of the most significant cryptocurrency breaches at the time. US authorities arrested Lichtenstein and Morgan in 2022 for laundering the stolen funds, recovering a large portion of the digital assets.
Both individuals pleaded guilty in 2023 and were sentenced to five years (Lichtenstein) and 18 months (Morgan) in federal prison. While Lichtenstein has remained in custody since his arrest, Morgan was scheduled to report to a federal facility on Jan. 24.

Following her sentencing in November 2024, Morgan made headlines again by returning to social media. Despite her criminal record, she has rebranded herself as “crypto’s favorite felon”, even launching a Cameo channel in December to monetize her notoriety.
Will Bitfinex Be Reimbursed?
While there were many victims of the 2016 Bitfinex hack, an October 2024 court filing indicated that Bitfinex itself may be the only entity eligible for reimbursement. The US government had invited impacted individuals to submit statements, but it remains unclear if any individuals will receive compensation.
As the Feb. 4 deadline approaches, the decision on the fate of the seized crypto remains in the hands of the court. If approved, it could mark one of the largest cryptocurrency restitutions in legal history. However, if the judge deems the request improper, the fate of the billions in seized crypto could take another legal turn.
